  1. GENERAL PROVISIONS
    1. These terms (hereinafter "the Terms") describe conditions of participation in the contest "Ustaw Mundial" (hereinafter "the Contest").
    2. The Contest is organised by WELL TOMEK, having its registered seat in Sieradz (Poland), ul. Władysława Łokietka 15/25, REGON 364381282, NIP (tax identification number) 8272274483 (hereinafter “the Organiser”).
    3. The Contest will be operated through a website (hereinafter “the Website”) available at https://ustawmundial.weszlo.com between 13/06/2018 and 16/07/2018.
    4. The Contest will be organised both on the territory of the Republic of Poland on the terms set out herein.
    5. The Organiser hereby represents that the Contest is not a game of chance, lottery, mutual bet, promotional lottery or any other chance-dependent game for the purposes of the act on gambling of 19th November 2009.
    6. The Organiser is solely responsible for the running of the Contest, the provision of the Website through which the Contest will be available, the determination of the Contest winners (hereinafter "the Winners") as well as management of distribution of the prizes (hereinafter "the Prizes") to the Contest Winners.
  2. CONTEST PARTICIPATION
    1. The Contest is available to adult individuals having full capacity to contract (hereinafter “the Contestant”) subject to the next sentence.
    2. Upon registration with the Contest will be required to:
      1. insert the Contestant’s e-mail address (social login included),
      2. insert the Contestant’s password and confirmation of given password (exception: social login),
      3. insert the Contestant’s name of a manager, name of the supported team and country.
    3. In the Contest it is forbidden to use vulgar names or descriptions.
    4. The Organiser's employees as well as their family members may participate in the Contest. However, they will not be eligible for the prizes and their taking prize-winning places will have no impact upon any other users' rights to claim prizes. Where a prize-winning place is taken by a person not eligible for the prizes, the prize for such place will be awarded to the person who has taken the next place.
    5. The Contestant may set up a maximum of 5 teams in the Contest. All Contestant's teams must be created on one registered account.
  3. OBJECT OF THE CONTEST
    1. The object of the Contest is to select a virtual football teams and manage them on the terms set out below in order to obtain a maximum score. The Contest is based on football matches of 2018 FIFA World Cup (hereinafter “the Competition”). Points are awarded per actual achievements of the players selected by the Contestant during the Competition.
    2. The Contest consists of 7 gameweeks (hereinafter “the Gameweeks”).
    3. Choice of the matches of the Competition is being made by the Organizer and is visible at the Matches page.
  4. REGISTERING A TEAM
    1. The Contestant may join the Contest at any time of its duration.
    2. Taking part in the Contest is free of charge. The Contest may be joined by submitting a duly completed electronic form available on the Website containing:
      1. the name of the team (hereinafter “the Team”), to be visible to all Contestants;
      2. names and surnames of 15 football players, selected from the transfer list, to make up the squad (hereinafter “the Squad”);
      3. names and surnames of 11 players of the Squad signed up for a given Gameweek, on the terms set out in section V of these Terms;
      4. name one of the players selected and signed up for a given Gameweek as a captain and one as vice-captain of the Squad.
    3. In order to enable the Contestants to set up Squads, the Organiser will publish a transfer list on the Website, i.e. a list of the football players available to the Contestants together with the conventional value of each player.
    4. Maximum number of players in the Squad from a single Club is written at the Gameweeks page.
    5. Maximum value of the Squad can be equal to the value for a specific Gameweek given at the Gameweeks page. Overdrawing this value is not allowed.
    6. The Contestant buys to the Squad following players: 2 goalkeepers, 5 defenders, 5 midfielders and 3 forwards.
    7. The Contestant can make changes in the Squad before a deadline of each Gameweek according to the rules described above.
  5. SQUAD SUBMISSION
    1. Out of the 15 football players of the Squad, the Contestant selects 11 players who set up a Squad’s lineup.
    2. Until the moment each time specified by the Organiser on the Website as a deadline for a given Gameweek, the Contestant may shape and change the composition of the Squad signed up for a given Gameweek as well as making transfers, i.e. “purchasing” and “selling” players of his/her Team within the specified budget and limitations.
    3. Until the moment of a deadline of the Gameweek 1 the Contestant may make as many transfers as he/she wish without any deduction points.
    4. Until the moment of a deadline of a gameweek (Gameweek 1 excluded) the Contestant may make as many transfers as he/she wish where numbers of gameweeks' free transfers (without deduction points) are defined in the list of Gameweeks. Each transfer over mentioned number means 4 deducted points from the Team's gameweek score.
    5. When the Contestant has not submitted his/her Squad within the deadline specified for signing up a Squad for a given Gameweek, the Organiser will deem the Team to be signed up with the same Squad as in a previous Gameweek.
  6. SCORING
    1. The players are awarded points based on their performance in real matches.
    2. The number of points scored by a Team of the Contestant is equal to the total scores won by each Squad submitted for each Gameweek.
    3. Total points scored by the Squad in a Gameweek are sum of points of the lineup players, considering all provided rules below about points of the Captain, Vice-captain and substitutes of the Squad.
    4. Points are only scored by the players who actually played in a given match, regardless of the length of presence on the pitch. The player gets points for a clean sheet or is penalized for goals conceded only when played 60 minutes or more.
    5. If a lineup player did not play, he is substituted by the highest priority outfield substitute who played in the Gameweek and doesn't break the formation rules.
    6. The player scores points for:
      1. Performace (including Extra Time):
        • 60 minutes or more: 2 points,
        • less than 60 minutes: 1 point.
      2. Goal:
        • goalkeeper: 8 points,
        • defender: 6 points,
        • midfielder: 5 points,
        • forward: 4 points.
        Penalty shoot-out: 1 point.
      3. Assist. Assists are awarded to the player from the goal scoring team, who makes the final pass before a goal is scored. An assist is awarded whether the pass was intentional (that it actually creates the chance) or unintentional (that the player had to dribble the ball or an inadvertent touch or shot created the chance). If an opposing player touches the ball after the final pass before a goal is scored, significantly altering the intended destination of the ball, then no assist is awarded. Should two opposing players touch the ball after the final pass before a goal is scored, then no assist is awarded. In case of doubt, a decision is made by the Organiser. Points according to the positions:
        • goalkeeper: 6 points,
        • defender: 4 points,
        • midfielder: 3 points,
        • forward: 3 points.
      4. Assist+. If a shot on goal of the player is saved by a goalkeeper or hits the woodwork, and a goal is scored from the rebound, then an assist+ is awarded. If a player shoots or passes the ball and forces an opposing player to put the ball in his own net, then an assist+ is awarded. In case of doubt, a decision is made by the Organiser. Points according to the positions:
        • goalkeeper: 3 points,
        • defender: 2 points,
        • midfielder: 2 points,
        • forward: 2 points.
      5. Clean sheet. A clean sheet is awarded for not conceding a goal whilst on the pitch and playing at least 60 minutes (excluding injury time). If a player is substituted when a goal is conceded then this loss still affects his clean sheet points. Points according to the positions:
        • goalkeeper: 4 points,
        • defender: 4 points,
        • midfielder: 1 point.
      6. Earning a penalty (Penalty awarded): 2 points, regardless a player position;
      7. Penalty save: 5 points. Shots off target are excluded. Penalty shoot-out: 1 point.
      8. Every 3 shot saves: 1 point (goalkeeper). Based on official statistics.
    7. The player loses points for:
      1. Goal conceded by the club of the player. Except the first one:
        • goalkeeper: minus 1 point,
        • defender: minus 1 point.
        If a player is substituted (and played at least 60 minutes) when a goal is conceded it affects his goal conceded points.
        Penalty shoot-out is excluded.
      2. Yellow card (regardless a player position) – minus 1 point.
      3. Red card (regardless a player position) – minus 3 points. When a player is shown two yellow cards (red card as a result) then he loses 3 points.
      4. Own goal (regardless a player position) – minus 2 points.
      5. Penalty caused (regardless a player position) – minus 2 points.
      6. Penalty missed (regardless a player position) – minus 2 points. Penalty shoot-out: -1 point.
    8. The points scored by the player appointed by the Contestant as the Squad Captain for a given Gameweek will be doubled. In the event that the Squad captain does not play in a Gameweek, his role is assumed by the vice-captain, whose scores are doubled accordingly. If neither the captain nor the vice-captain play in a match, the points scored by the substitutes substituting them will not be doubled.
    9. Points are awarded based on the statistics published by the Organiser. The statistics are subject to verification and may be changed either during or after a given Gameweek. For the purposes of the Contest, the scoring published on the Website is final, subject to the right to lodge a complaint.
  7. RANKINGS
    1. Overall Rank of Teams - comprises all Teams registered with the Contest and shows the sum total of the points awarded in the Contest. The Contestant whose Team has won the greatest total number of points, will become the Contest Winner.
    2. Overall Rank of Managers - comprises all Managers registered with the Contest and shows the sum total of the points awarded in the Contest. The Contestant whose Manager has won the greatest total number of points, will become the Rank of Managers Winner. Score of the Manager in the single Gameweek is the sum of the points of all Teams of the Manager.
    3. Overall Rank of Leagues - comprises all Private Leagues registered with the Contest and shows the sum total of the points awarded in the Contest. The Contestant whose League has won the greatest total number of points, will become the Rank of Leagues Winner. One Manager may own only one private league. One Team may participate in maximum of 15 private leagues.
    4. Gameweek Rank of Teams - comprises all Teams registered with the Contest and shows the Gameweek points awarded in the Contest. The Contestant whose Team has won the greatest total number of points, will become the Gameweek Winner.
    5. Gameweek Rank of Managers - comprises all Managers registered with the Contest and shows the Gameweek points awarded in the Contest. The Contestant whose Manager has won the greatest total number of points, will become the Managers Gameweek Winner.
    6. Gameweek Rank of Leagues - comprises all Leagues registered with the Contest and shows the Gameweek points awarded in the Contest. The Contestant whose League has won the greatest total number of points, will become the Leagues Gameweek Winner. Score of the League in the Gameweek is the sum of Gameweek’s points of the best (looking at the Overall Rank) 10 Teams of different Managers in the League that joined the league at least at the moment of the final calculation of the Gameweek.
    7. In case of two or more Contestants have achieved equal total scores, then the order in the Ranking is determined based on the Rule of Precedence, i.e. the time the Team/Manager/League was created (the earlier time, the higher ranking).
  8. PRIZES
    1. During the Contest, the Organiser may offer prizes. The types of prizes and conditions of their award will be expressly stipulated on the Website. The offer of prizes will not be deemed as an amendment to these Terms.
  9. AWARDING PRIZES
    1. Conditions of awarding prizes will be expressly stipulated on the Website. It will not be deemed as an amendment to these Terms.
  10. COMPLAINTS PROCEDURE
    1. Each Contestant may lodge a complaint with the Organiser in connection with the Contest.
    2. Complaints may be submitted in writing to the Organiser’s address: WELL TOMEK, ul. Władysława Łokietka 15/25, 98-200 Sieradz, Poland, providing a mailing address to which a response may be sent, or by email to: ustawmundial@gmail.com.
    3. A complaint must contain: name, surname and mailing address of the person making a claim, as well as a detailed specification of the grounds for the complaint and the claim itself.
    4. Complaints may be lodged throughout the duration of the Contest and not longer than within 14 business days of the date the List of Laureates is published. The deadline for lodging a complaint will be deemed to be observed based on the date on the postal stamp, date of dispatch of a messenger parcel containing the complaint or date of registration by the server of an email containing the complaint.
    5. The Organiser has 7 business days of receipt of a complaint to process it. The Organiser will respond, as soon as the compliant has been handled, to the Contestant who lodged a complaint in writing by registered mail to the mailing address provided by the Contestant and additionally by email. Complaints made by email will be responded by email.
    6. A Contestant whose complaint has not been admitted may enforce any claims by way of litigation before a relevant court of law.

  12. DATA PROCESSING
    1. Administratorem danych osobowych Uczestników zbieranych w trakcie Konkursu (dalej: „Dane”) jest WELL TOMEK, z siedzibą w Sieradzu, przy ul. Władysława Łokietka 15/25, e-mail: welltomek@gmail.com, tel. +48880666366. (dalej: „Administrator”).
    2. Administrator przetwarza Dane w zakresie niezbędnym do przygotowania i realizacji Konkursu, zgodnie z niniejszym Regulaminem, tj. w celu przyjęcia zgłoszenia do Konkursu, ustalenia wyników Konkursu, wydania Nagród, ogłoszenia wyników Konkursu, rozpatrzenia reklamacji.
    3. Na potrzeby Konkursu przetwarzane są następujące dane Uczestników: adres e-mail. W przypadku zwycięzców Konkursu przetwarzane są również dane w postaci: imię, nazwisko, wiek, numer telefonu, adres zamieszkania (dane wymagane do wydania nagrody).
    4. Dane Uczestników Konkursu, którzy nie zostali zwycięzcami Konkursu zostaną usunięte lub zanonimizowane w terminie 1 miesiąca, licząc od rozstrzygnięcia Konkursu. Administrator informuje, że upływ powyższego terminu nie pozbawia prawa do złożenia reklamacji lub zgłoszenia roszczeń w innym trybie. W takim jednak wypadku osoba składająca reklamację będzie zobowiązana do wykazania samodzielnie wszystkich okoliczności, na których opiera swoje twierdzenia.
    5. Dane zwycięzców Konkursu będą przetwarzanie przez okres niezbędny do spełnienia obowiązków prawnych ciążących na Administratorze (przepisy podatkowe, ew. roszczenia dotyczące gwarancji, rękojmi, a także przyznania lub realizacji Nagrody zgodnie z Regulaminem).
    6. Dane Uczestników Konkursu mogą być przetwarzane dłużej niż to wynika z punków poprzedzających, jeżeli będzie to niezbędne dla rozpatrzenia reklamacji lub innej formy roszczeń zgłoszonych przez Uczestnika, a także na potrzeby ewentualnych postępowań sądowych lub administracyjnych.
    7. Dane są chronione środkami technicznymi i organizacyjnymi, aby zagwarantować odpowiedni poziom ochrony, zgodnie z obowiązującymi przepisami.
    8. Administrator nie pozyskuje Danych od podmiotów trzecich lub ze źródeł powszechnie dostępnych i przetwarza wyłącznie Dane podane przez Użytkownika.
    9. Na potrzeby realizacji Konkursu Dane będą udostępniane następujących kategoriom podmiotów: podmiotom kurierskim - w celu przekazania nagrody rzeczowej, podmiotom świadczącym usługi płatnicze - w celu przekazania nagrody pieniężnej.
    10. Podstawą przetwarzania Danych wynikającego z uczestnictwa w Konkursie jest art. 6 ust. 1 pkt c) Ogólnego Rozporządzenia o Ochronie Danych Osobowych z dnia 27 kwietnia 2016 r. (RODO) – tj. spełnienie obowiązków prawnych związanych z organizacją Konkursu.
    11. Uczestnikom przysługuje prawo do:
      • uzyskania informacji na temat przetwarzania Danych, w tym o kategoriach przetwarzanych danych i ewentualnych odbiorcach danych.
      • żądania skorygowania nieprawidłowych Danych lub uzupełnienia niekomplenych Danych,
      • żądania usunięcia lub ograniczenia przetwarzania Danych - przy czym żądanie zostanie spełnione, jeżeli spełnione zostaną wymogi prawne dotyczące takiego żądania,
      • przenoszenia Danych – poprzez otrzymanie Danych od Administratora w formacie umożliwiającym ich przekazanie wybranemu podmiotowi trzeciemu,
      • złożenia skargi do organu nadzorczego - Prezesa Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00 - a193 Warszawa – w przypadku stwierdzenia, że Dane są przetwarzane sprzecznie z prawem.
    12. Wszelkie wnioski, pytania i żądania związane z przetwarzaniem Danych powinny być kierowane na adres: welltomek@gmail.com.
  13. FINAL PROVISIONS
    1. In the event of a match being rescheduled, repeated, cancelled, or in any other situations not provided for in these Terms, the decision on how points are to be awarded and which standings will be affected will be made by the Organiser.
    2. The Organiser hereby informs that any events that are not part of standard operation of the Contest which cause or may cause disruptions to the running of the Contest may affect its operation. In such cases, the Organiser will decide whether or not to continue with the Contest.
    3. A Contestant may resign from the Contest by sending a resignation in writing to the Organiser’s address, as well as by email to the address: ustawmundial@gmail.com. A resignation by a Laureate entails a waiver of the right to the Prize awarded.
    4. The Organiser has the right to amend these Terms in the event that, e.g., it is necessary to provide for changes in the law, make precise any provisions arising doubts of Contestants or in order to better protect Contestants, insofar as it will not adversely affect the terms of participation in the Contest or the basic rules of the Contest. Any amendments to these Terms will not affect any rights already acquired by the Contestants. The information on any amendments to these Terms will be published on the Website or sent by email to all Contestants who joined the Contest prior to such amendments and agreed to their data being processed.
    5. Contestants will be notified of any amendments to these Terms in advance so as to enable them to familiarise themselves with such amendments and, if applicable, to withdraw from the Contest. Should a Contestant not accept any of the amendments to these Terms, he/she may withdraw from the Contest without any adverse consequences.
    6. In matters not regulated herein, the relevant provisions of the law will apply.
    7. In case of language discrepancy in these Terms, the Polish version shall prevail.
    8. These Terms will be binding from 13.06.2018 until the end of the Contest, subject to its provisions – to a relevant extent – remaining in force for the purposes of the complaint procedure.
    9. These Terms do not affect the rights of the Contestants as Consumers under the applicable regulations, which take precedence over these Terms.
